You need to click off the stack then click back on the stack hex to avoid this issue. This tends to happen in larger stacks where not all units are visible in the hex info area.

When a units in a stack is selected to move to the top (or move to the bottom) a unit that occupies the position in the stack that the selected unit occupied can become highlighted. Any subsequent actions will affect both units.

I do not know if this is by design.
